Police Safety Orders
Where an individual is a victim of family violence, and a person requires immediate protection from another, the Police have powers to issue a police safety order against an individual(s) for a period of time. Where necessary, the Police can extend the time of which a police safety order is in place.
If you are in immediate danger or risk of harm, the Police are the best contact and can provide advice as to how best you can protect yourself and your loved ones. If necessary, a safety order will be issued to protect a person from another while a protection order is sought, should an individual feel they require ongoing and permanent protection from another.
Whether an officer will issue a safety order is dependent on a person’s circumstances and the event which required police intervention. The Police will consider the relationship between the victim and the inflictor of family violence, whether it is likely to occur again, the welfare of any children (if any), the severity and level of hardship a person may endure if a safety order was not in place.
A Police safety order is not a permanent or everlasting solution for the protection of yourself and your family. A protection order will provide the best protection. For more information on protection orders, read my blog on how they work and how to obtain one.
